Il servizio fornito su questo sito (voxlab.it) è svolto da Giuseppe Civello e Zen Art per la parte amministrativa fatture – pagamento – tassazione contributi. La piattaforma fornisce uno strumento casting per clienti da parte dei voice talent registrati al sito per produzioni audio.

Condizioni di servizio

Il servizio fornito su voxlab.it è costituito nei presenti Termini e Condizioni che disciplinano l’uso del Sito e le condizioni di utilizzo del servizio. Utilizzando il Sito, sia come visitatore, utente registrato o cliente, l’utente accetta e senza riserve le condizioni d’uso.

1. Parti del contratto

Le seguenti condizioni di voxlab.it, regolamentano il rapporto tra voxlab.it e i singoli utenti registrati.

Utilizzando il Sito e/o i Servizi, l’Utente dichiara di essere vincolato ai sensi della legge che disciplina il proprio luogo di residenza e nazionalità. La registrazione può essere completata solo da persone maggiorenni.

1. Registrazione e formalizzazione del Contratto
   1. L’utilizzo di voxlab.it prevede la registrazione compilando un modulo di registrazione/richiesta preventivo accettando i termini di utilizzo e l’informativa sulla privacy, tuttavia gli utenti non registrati possono comunque cercare profili e visualizzare una versione limitata del sito. Sia gli utenti registrati che quelli non registrati accettano i presenti Termini di servizio.
   2. Procedura Registrazione Voice Talent nel database

La formalizzazione del contratto d’uso è effettuata come segue:

Il voice talent richiede la formalizzazione di un contratto per l’utilizzo del sito web compilando, confermando e inviando il modulo di registrazione e dopo aver accettato la Privacy Policy e i Termini. Il sistema inoltrerà conferma di registrazione con un link che confermerà la ricezione della domanda di inserimento al database all’indirizzo di posta elettronica indicato.

Cliccando sul link ricevuto verrà formalizzato un contratto tra Voxlab.it e il voice talent per l’utilizzo dei servizi attivando il profilo sull’area riservata dedicata. Sarà possibile accedere con nome utente e password e compilare i propri dati e caricare il materiale demo che sarà revisionato e approvato per l’inserimento definitivo sulla piattaforma rispettando requisiti professionali che vengono richiesti per l’inserimento ovvero essere uno voice talent professionista e poter fornire una buona qualità audio al momento dell’incarico. Le demo che si potranno inserire dovranno rispettare un massimo di 4 mb a file e dovranno essere divise per categoria. Showreel Commecial, ShowReel Voice Over, e un test dal proprio home studio.

3. Casting Speaker e Allert Progetto

Ad ogni richiesta di lavoro o preventivo riceverete una mail allert. Nella quale si invita ad accedere alla vostra area utente per prendere visione del progetto e valutare l’eventuale adesione. In alcuni casi è richiesto un casting di una parte del testo. Non è obbligatorio fornire un casting ma è consigliato per aumentare le possibilità da parte del cliente di essere scelti. Consigliamo di proteggere il vostro casting da un watermark o cambiando alcune parole del testo originale. Onde evitate possibili usi impropri. Se non si effettua il casting il sistema seleziona in automatico la vostra demo in archivio. Potrebbero esserci occasioni in cui il budget viene suggerito laddove il cliente deve rientrare in un budget specifico e troverete il prezzo suggerito. Nel caso non sia in linea alle vostre esigenze potete rifiutare il progetto tramite l’opzione dedicata.

1. Utilizzo del sito web da parte degli utenti
   1. L’utente può essere sia un utente professionista dei servizi gratuiti offerti da voxlab.it, sia un cliente dei servizi che necessita dei servizi compilando una richiesta di preventivo attraverso il form.
   2. L’Utente registrato è l’unico responsabile della riservatezza del nome utente e della relativa password. Sarà quindi responsabile di qualsiasi utilizzo, accedendo con il proprio nome utente e password.
   3. Voxlab.it può limitare o impedire l’accesso ai servizi senza preavviso se:
      • L’utente viola una qualsiasi delle presenti Condizioni d’uso o diritti di proprietà o intellettuale di voxlab.it
      • L’utente utilizza il servizio per scopi illegali o criminali
      • Uso non autorizzato di nome utente e password.
2. Utilizzo del sito Web per gli utenti: termini, commissioni, termini di pagamento.

Voxlab.it fornisce l’accesso a un database di voci in cui l’artista speaker può pubblicare le proprie demo e tariffe attraverso il sistema di castlist. Il cliente può assumerli per svolgere lavori audio tramite la piattaforma compilando un form di richiesta con tutti i dati necessari per attivare il progetto e la relativa castlist.

1. 1. Modalità di servizio e Commissioni

Sia i voice over talent che gli acquirenti di servizi possono registrarsi su voxlab.it gratuitamente. Non ci sono pagamenti mensili. Voxlab.it percepirà una commissione su ogni lavoro svolto.

1. 1. Modalità di pagamento Clienti/Utenti professionisti

Il pagamento dei professionisti di solito viene evaso dopo la prestazione approvata dal cliente. Diversamente i pagamenti possono avere un’attesa di 30/60 gg dall’emissione della fattura.

Voxlab.it offre le seguenti soluzioni di pagamento:

1. 1. • PayPal.
      • Addebito su conto corrente Bancario

I clienti che voglio usufruire dei servizi nella maggior parte dei casi i pagamenti vengono richiesti anticipati. Una volta inviata fattura e saldato il dovuto si procede alla registrazione richiesta. Diversamente non sarà possibile evadere nessuna produzione audio senza saldo o acconto.

6. Contenuti inclusi dagli Utenti

I testi, la musica, le immagini, le registrazioni audio, inviate dagli utenti saranno sotto la loro esclusiva responsabilità.

Voxlab.it ritiene impossibile il controllo dei contenuti inseriti dagli utenti e l’utente ne riconosce l’accettazione nell’accettare le presenti Condizioni. L’utente si assume espressamente ogni responsabilità di qualsiasi natura derivante dagli elementi da lui introdotti nel gestionale.

In ogni caso, l’Utente si impegna ad astenersi dall’introdurre, per l’utilizzo nello strumento, i seguenti contenuti:

1. 1. • Contenuto illegale
      • Contenuti considerati pornografici, volgari o osceni, molesti o che possono essere considerati in qualche modo offensivi anche se non violano la legge.
      • Contenuti estremisti, razzisti o xenofobi o pubblicati da gruppi vietati
      • Il contenuto interferisce con i diritti di terzi (inclusi i diritti delle persone, i diritti di proprietà intellettuale, i diritti d’autore, i diritti di brevetto e qualsiasi altro diritto di terzi).
      • Contenuti che potrebbero danneggiare l’immagine pubblica, la reputazione o il marchio di Voxlab.it e quella dei suoi partner, dipendenti, altri utenti del servizio o terze parti.

Voxlab.it si riserva il diritto di sospendere o terminare l’utente che utilizza o inserisce uno qualsiasi di tali contenuti menzionati.

7. Contenuti scaricati da o verso Social Network o qualsiasi altro servizio Internet

Voxlab.it tra i suoi servizi può offrire all’utente la possibilità di importare o esportare da o verso altri servizi Internet o social network, materiale o contenuti.

L’utente riconosce espressamente che Voxlab.it offre esclusivamente, e ove opportuno, il supporto necessario per tali operazioni e che in nessun caso può esercitare alcuna attività di controllo sui propri contenuti.

L’Utente dichiara espressamente la proprietà o il possesso della licenza di qualsiasi contenuto caricato su o da altri servizi Internet.

Allo stesso modo, l’Utente dichiara che tali servizi sono completamente estranei a Voxlab.it. L’utente soddisfa tutti i termini e le condizioni richiesti da ciascuno di questi servizi Internet o social network. E in base a tali riconoscimenti, risponderà a qualsiasi pretesa, danno, indennizzo, risarcimento o qualsiasi altro costo che il suo utilizzo sarebbe generato a Voxlab.it. Comprese le spese di consulenza e le spese legali.

1. 1. Diritti di utilizzo registrazioni audio e tariffe

Ogni registrazione comprende un costo di incisione e in alcuni casi i diritti di utilizzo variabile in base al tipo di distribuzione. Pertanto nel caso di rinnovo di diritti si concorderà con lo speaker e lo studio la tariffa aggiornata per la nuova programmazione.

Altri progetti di voiceover sono full buyout; gli artisti non riceveranno alcun reddito futuro o royalty per il loro lavoro e gli acquirenti possono utilizzare le registrazioni in qualsiasi prodotto che desiderano durante il periodo di tempo massimo consentito.

Gli artisti Voiceover inseriranno le loro tariffe in modo che voxlab.it imposterà una castlist con demo o casting laddove richiesto e prezzi differenti per i clienti.

Il professionista può rifiutare una lavoro sia per impossibilità di partecipare all’audizione o laddove in certi casi viene impostato un budget dopo l’invio del casting e viene ritenuto un  compenso non adatto alle proprie esigenze.

Gli speaker riceveranno i pagamenti dopo che i lavori sono stati completati e contrassegnati come approvati dai clienti

I clienti possono richiedere revisioni gratuite entro un certo limite purché non apportino modifiche allo script o alle istruzioni fornite durante il brief. In caso di disaccordo apriremo una controversia e si procederà alla valutazione.

L’Utente si impegna in ogni momento a rispettare la legge del proprio luogo di residenza in merito all’utilizzo o alla visualizzazione delle registrazioni audio e si assume ogni responsabilità in merito alla loro visualizzazione o utilizzo.

La vulnerabilità di qualsiasi termine del presente contratto eliminerebbe la licenza e, se necessario, risolverà automaticamente il presente contratto senza che l’utente possa richiedere il rimborso delle somme pagate.

Obblighi contrattuali degli utenti

1. 1. Gli utenti sono tenuti a proteggere i propri dati di accesso ai siti Web dall’uso non autorizzato degli stessi da parte di terzi. I dati di accesso, in particolare la password non possono essere divulgati, trasferiti o trasmessi in alcun modo. L’utente è responsabile di qualsiasi condotta non autorizzata resa possibile da abuso o accesso illegittimo ai propri dati per l’utilizzo dei servizi associati a causa di atteggiamento negligente o doloso dell’utente o del professionista nella custodia dei propri dati di accesso.

Se l’utente è a conoscenza del fatto che le sue informazioni di accesso sono state divulgate a terzi, sarà obbligato a modificare immediatamente la sua password. Se ciò non è possibile, deve riferire immediatamente a voxlab.it

Durante il processo di registrazione, l’utente o professionista è tenuto a fornire un indirizzo e-mail e un indirizzo postale dove sarebbe sempre raggiungibile. Gli utenti accettano di utilizzare questo indirizzo e-mail come indirizzo a scopo di notifica nel contesto del loro rapporto con Voxlab.it per comunicazioni.
   2. L’indirizzo email valido dell’utente o professionista è esclusivamente l’ultimo fornito a Voxlab.it.  In caso di modifica, l’utente è obbligato a fornire immediatamente un nuovo indirizzo e-mail. L’Utente sarà responsabile di eventuali effetti o danni causati da un’eventuale mancata comunicazione del nuovo indirizzo di posta elettronica.
   3. L’Utente si impegna a non utilizzare o inoltrare materiali o software che possano mettere in pericolo, danneggiare o distruggere la funzionalità o la disponibilità della piattaforma, file, link contributi che contengono virus o qualsiasi servizio che potrebbe paralizzare i servizi del sito web.
   4. L’Utente si impegna a non modificare, sovrascrivere o cancellare alcun contenuto creato o gestito da voxlab.it o da altro utente o professionista.

 

1. Proprietà intellettuale, contenuto e utilizzo dei video scaricati.
   1. Proprietà di Voxlab.it
      • Voxlab.it è titolare dei diritti di proprietà intellettuale del Sito, ed è anche titolare o possiede l’apposita licenza in materia di diritti di proprietà intellettuale e di immagine di tutti i contenuti disponibili per suo tramite ad eccezione di tutti i contenuti generati dall’utente che appartengono all’autore.
      • In ogni caso, l’accesso, la navigazione o l’utilizzo del servizio da parte dell’Utente comporta la rinuncia, la licenza o il trasferimento di tutti o parte di tali diritti da parte di Voxlab.it
      • L’utente riconosce espressamente che l’uso del servizio oggetto del contratto non creerà alcun diritto di trasmissione di proprietà intellettuale né concederà a questo utente alcuna licenza sui contenuti detenuti da Voxlab.it al di fuori di quanto è proprio del servizio e dei limiti di cui all’art. sezione 4.5 dei presenti Termini.

      • Vietato modificare, copiare, riutilizzare, sfruttare, riprodurre, comunicare pubblicamente, eseguire copie seconde o successive, caricare file, pubblicare, trasmettere, utilizzare, elaborare o distribuire in qualsiasi modo tutto o parte del contenuto nel Sito web in un modo diverso di utilizzo che è proprio del servizio fornito se non si dispone dell’espresso consenso scritto di Voxlab.it
      • L’assunzione di servizi di voiceover non genera diritti di proprietà intellettuale sulle registrazioni audio; solo ​​diritto di utilizzo.    2. L’utente si assume espressamente la piena responsabilità per eventuali reclami nei confronti di Voxlab.it, in conseguenza dell’uso che l’utente finale fa dei video, effettuati con questo servizio. Compresi eventuali costi di difesa legale, procedimenti legali o sanzioni amministrative.

L’utilizzo del sito o dei servizi forniti è a rischio e pericolo dell’utente, pur avendo adottato tutte le misure ragionevoli per garantire ciò, non può assolutamente garantire che il contenuto associato al servizio sia privo di errori o che l’uso di tale materiale non violi diritti di terzi.

Voxlab.it non può né garantire che gli aspetti funzionali del sito siano esenti da errori o talvolta bug né che il sito o server che lo rendono disponibile siano privi di virus o altri componenti dannosi. Voxlab.it si riserva il diritto di correggere eventuali errori nel proprio sito web.

Se l’utilizzo del Sito Web o i risultati di altri contenuti o servizi generano la necessità di riparare o sostituire proprietà, materiali, apparecchiature o dati, o causano lesioni a persone o danni a proprietà, la Società non è responsabile per i costi generati.

Voxlab.it si riserva il diritto di risolvere il contratto con l’utente o professionista e di impedire l’accesso ai siti web quando:

1. 1. Modalità di rescissione di un contratto

La risoluzione da parte dell’Utente o del Professionista deve avvenire per iscritto, tramite e-mail inviata dall’e-mail che l’utente ha registrato nel suo account Voxlab.it

1. Legge applicabile e foro competente, nullità

Il contratto contenuto in questi Termini e Condizioni è soggetto alla legge Italiana.

Le parti del contratto soggette a questi Termini e Condizioni accettano di sottoporre eventuali discrepanze sullo scopo, contenuto o interpretazione degli stessi in tutti i casi in cui una legge obbligatoria non designa diversamente.

Qualora una o più disposizioni delle presenti Condizioni Generali fosse dichiarata nulla da un tribunale, tale dichiarazione di nullità non pregiudicherà la validità delle restanti disposizioni del contratto, che rimarranno valide, applicabili ed esecutive alle parti.

3. Casting Speaker and Project Allert

6. Content included by Users

In any case, the User undertakes to refrain from introducing, for use in the tool, the following contents:

Voxlab.it among its services may offer the user the possibility of importing or exporting from or to other Internet services or social networks, material or content.

The user expressly acknowledges that Voxlab.it offers exclusively, and where appropriate, the necessary support for such operations and that in no case can he exercise any control activity on his own contents.

The User expressly declares the ownership or possession of the license of any content uploaded to or from other Internet services.

1. 1. Rights to use audio recordings and rates

Other voiceover projects are full buyouts; artists will not receive any future income or royalties for their work and buyers can use the recordings in any product they wish during the maximum time allowed.

Voiceover artists will enter their rates so that voxlab.it will set up a castlist with demo or casting where required and different prices for customers.

The professional can refuse a job either due to inability to participate in the audition or where in certain cases a budget is set after the casting has been sent and a fee is deemed not suitable for one’s needs.

Speakers will receive payments after jobs are completed and marked as approved by clients

Clients can request free reviews within a certain limit as long as they do not make any changes to the script or instructions provided during the brief. In case of disagreement we will open a dispute and proceed to the evaluation.

The User undertakes at all times to comply with the law of his place of residence regarding the use or display of audio recordings and assumes all responsibility for their display or use.

The vulnerability of any term of this agreement would eliminate the license and, if necessary, automatically terminate this agreement without the user being able to request a refund of the sums paid.

Contractual obligations of users

Users are required to protect their access data to websites from unauthorized use of the same by third parties. The access data, in particular the password, may not be disclosed, transferred or transmitted in any way. The user is responsible for any unauthorized conduct made possible by abuse or illegitimate access to his data for the use of the associated services due to the negligent or malicious attitude of the user or the professional in the custody of his access data.

If you are aware that your login information has been disclosed to third parties, you will be obliged to change your password immediately. If this is not possible, you must immediately report to voxlab.it

During the registration process, the user or professional is required to provide an e-mail address and a postal address where he would always be reachable. Users agree to use this e-mail address as an address for notification purposes in the context of their relationship with Voxlab.it for communications.
   2. The valid email address of the user or professional is exclusively the last one provided to Voxlab.it. In the event of a change, the user is obliged to immediately provide a new e-mail address. The User will be responsible for any effects or damages caused by any failure to communicate the new e-mail address.
   3. The User undertakes not to use or forward materials or software that could endanger, damage or destroy the functionality or availability of the platform, files, links, contributions that contain viruses or any service that could paralyze the services of the website.
   4. The User undertakes not to modify, overwrite or delete any content created or managed by voxlab.it or by any other user or professional.

 

1. Intellectual Property, Content and Use of Downloaded Videos.
   1. Property of Voxlab.it
      • Voxlab.it is the owner of the intellectual property rights of the Site, and is also the owner or possesses the appropriate license regarding the intellectual property rights and image of all the contents available through it except for all the contents generated by the user that belong to the author.
      • In any case, access, navigation or use of the service by the User involves the waiver, license or transfer of all or part of these rights by Voxlab.it
      • The user expressly acknowledges that the use of the service object of the contract will not create any right of transmission of intellectual property nor will it grant this user any license on the contents held by Voxlab.it outside of what is proper to the service and the limits of referred to in art. section 4.5 of these Terms.

1. 1. Prohibition of availability
      • It is forbidden to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent copies, upload files, publish, transmit, use, process or distribute in any way all or part of the content on the Website in a different way of use that belongs to the service provided if you do not have the express written consent of Voxlab.it
      • Hiring voiceover services does not generate intellectual property rights on audio recordings; right of use only. This does not affect the intellectual property rights for items entered by the user in the templates. Elements on which they will understand any intellectual property rights for themselves regardless of the ensemble resulting from the use of the service.
   2. Use of the website

Except as permitted by these Terms and Conditions applied to the models available to users, and their use as a correspondent, it is expressly forbidden:

   2. The user expressly assumes full responsibility for any complaints against Voxlab.it, as a result of the use that the end user makes of the videos, made with this service. Including any legal defense costs, legal proceedings or administrative penalties.

The use of the site or the services provided is at the user’s own risk, although he has taken all reasonable measures to ensure this, he cannot absolutely guarantee that the content associated with the service is error-free or that the use of such material does not violate the rights of third parties.

Voxlab.it can neither guarantee that the functional aspects of the site are free from errors or sometimes bugs nor that the site or server that make it available are free of viruses or other harmful components. Voxlab.it reserves the right to correct any errors on its website.

If the use of the Website or the results of other content or services generate the need to repair or replace property, materials, equipment or data, or cause injury to persons or property damage, the Company is not responsible for the costs generated.

At the same time, the user must take security measures on his computers as generally deemed appropriate.

1. Changes to the Terms and Conditions

Voxlab.it reserves the right to modify or extend these terms and conditions in the future. Any changes or additions will be at our discretion, will be indicated on the website or sent by email to each registered user individually at the email address registered at the time of the changes.

If the User does not explicitly object before the expiry of the term of his subscription in force, or in any case within one month, the changes or additions are considered accepted.

Voxlab.it reserves the right to terminate the contract with the user or professional and to prevent access to websites when:

        • transmits or transfers your account to another user.

        • engages in activities, provides opinions or anything that includes illegal or offensive content.
        • undertakes any activity deemed inappropriate within the Voxlab.it platform

In the event of termination and cancellation of the account within the terms indicated, the user or professional, the subject of this penalty, has no right to recover the blocked account. In this case, access to the site or a new registration, even through other accounts or other user names, is precluded.

1. 1. How to terminate a contract

The termination by the User or the Professional must take place in writing, by e-mail sent from the e-mail that the user has registered in his Voxlab.it account.

1. Applicable law and competent court, nullity

The contract contained in these Terms and Conditions is subject to Italian law.

The parties to the contract subject to these Terms and Conditions agree to submit any discrepancies as to the purpose, content or interpretation thereof in all cases where a mandatory law does not designate otherwise.

Should one or more provisions of these General Conditions be declared null and void by a court, this declaration of nullity will not affect the validity of the remaining provisions of the contract, which will remain valid, applicable and enforceable to the parties.
